These Terms of Service govern your use of Album Foundry as a fan and buyer. By using Album Foundry you agree to these terms.
Album Foundry is operated by Handmation Media LLC (d/b/a Album Foundry), an Oregon limited liability company ("we," "us," "our").
1. What Album Foundry Is
Album Foundry is a music platform where artists sell permanent digital downloads directly to fans. Each purchase includes digital audio and, where applicable, bespoke cover art. Artists retain ownership of their music and artwork. Fans purchase a personal license to the recordings and art they choose. Album Foundry provides the platform connecting them.
2. What You Are Buying
When you purchase music on Album Foundry, you are purchasing a personal, non-exclusive, non-transferable license to listen to the music and enjoy the artwork. You are not purchasing ownership of the copyright, the master recording, or any other intellectual property rights.
Your license permits you to:
- Download the audio in the available formats (MP3, FLAC where offered)
- Listen on your personal devices
- Make personal backup copies
- Share within your immediate household
- Display the cover art for personal enjoyment
Your license does not permit you to:
- Resell, redistribute, or transfer the music or artwork to others
- Use the music in videos, films, podcasts, or any audiovisual production
- Perform the music publicly or broadcast it
- Use the music or artwork commercially in any way
- Upload the music to streaming services or other distribution platforms
- Use the music or artwork to train, develop, or inform artificial intelligence systems of any kind
Violation of these terms terminates your license immediately.
3. Payment and Pricing
Prices are displayed in US dollars unless otherwise indicated. Payment is processed securely by Stripe. Album Foundry does not store your payment details.
4. Downloads
When you complete a purchase you will receive access to your downloads. You have 7 days to download your files. Once you have successfully downloaded your purchase, Album Foundry's delivery obligation is fulfilled. Your files are yours to keep.
Keep your order confirmation email — it contains your download link. If you have trouble with your download contact us at support@albumfoundry.com.
5. Refunds
All sales are final. Digital downloads are non-refundable once access has been granted.
For UK and EU customers: You have a statutory 14-day right to withdraw from digital purchases. By confirming your purchase and initiating your download, you explicitly waive this right in accordance with the UK Consumer Rights Act 2015 and EU Consumer Rights Directive. You will be asked to confirm this before your download begins.
6. Cover Art
Where bespoke cover art is included with your purchase, it is licensed for personal display and enjoyment only. You may not resell it, reproduce it commercially, use it in merchandise, or claim it as your own work.
7. Your Account
If you create an account, you are responsible for keeping your login credentials secure. Contact us immediately at support@albumfoundry.com if you suspect unauthorised access.
You must be at least 13 years old to use Album Foundry.
8. Acceptable Use
Use of Album Foundry is subject to our Acceptable Use Policy, which is incorporated into these terms by reference.
9. Limitation of Liability
Album Foundry's total liability to you for any claim is limited to the amount you paid for the specific purchase giving rise to the claim, or $100, whichever is greater.
Album Foundry is not liable for any indirect, incidental, or consequential damages, even if advised of the possibility of such damages.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Disputes
Before filing any legal claim, please contact us at support@albumfoundry.com and give us the opportunity to resolve the issue. If a formal dispute is necessary, these terms are governed by the laws of the State of Oregon. Disputes will be subject to the exclusive jurisdiction of the state and federal courts of Washington County, Oregon.
UK and EU customers: Nothing here affects your statutory rights under UK or EU consumer law. You may bring proceedings in the courts of your country of residence. EU users may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Changes to These Terms
We may update these terms from time to time. We will update the effective date at the top of this page when we do. Continued use of Album Foundry after changes take effect constitutes acceptance of the revised terms.
